Ap*640peals (1) from a judgment of the County Court of Rensselaer County (Lamont, J.), rendered February 9, 1996, upon a verdict convicting defendant of the crime of robbery in the first degree, and (2) by permission, from an order of said court (McGrath, J.), entered September 24, 1998, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment of conviction.

Defendant was convicted of robbery in the first degree as a consequence of his January 1995 assault upon a 70-year-old woman in the City of Troy, Rensselaer County, during which he forcibly seized her purse…
