Plaintiff United States brought this civil action under the Rivers and Harbors Act, ch. 425, 30 Stat. 1148 (codified as amended in scattered sections of 33 U.S.C.) (“Rivers and Harbors Act”) and the Clean Water Act, Pub.L. No. 95-217, 91 Stat. 1566 (codified as amended in scattered sections of 33 U.S.C.)
