Defendant herein was sentenced in this court, following a jury verdict of guilty of rape in the first degree, to a term of one day to life under the provisions of section 2189-a of the former Penal Law. The sentence was pronounced April 29,1970 but the crime was committed on April 25, 1966, hence the applicability of the provisions of the former Penal Law. Defendant is now in the Attica Correctional Facility. It should be noted that the judgment was affirmed by the Appellate Division, Third Department (People v. Hutchings, *1636 A D 2d 659) and thereafter leave to appeal to the Court of Appeals…
