On July 29, 1903, a complaint was filed in the police court of the city of Assaria, a city of the third class, charging W. D. Wells in two counts' *788with selling intoxicating liquors, and in the third count with maintaining and keeping a nuisance, in violation of an ordinance of the city. In the police court he was found guilty on all three counts, and fined fifty dollars on each. From this judgment of the police court he appealed to the district court of Saline county.
