In a proceeding pursuant to CPLR article 78 to review a determination of the Zoning Board of Appeals of the Village of Quogue, which denied the petitioners’ application for a building permit, the appeal is from a judgment of the Supreme Court, Suffolk County (McCarthy, J.), entered January 5, 1988, which, inter alia, granted the petition and annulled the determination.

Ordered that the judgment is reversed, on the law, without costs or disbursements, and the proceeding is dismissed on the merits.
