—This was an action by the appellees against the appellants to enjoin the collection of certain gravel road assessments upon the property of the plaintiffs, all th'e land within the specified distance from the road not being listed and returned. The cáse has once before been in this court, *80and it was decided that- the complaint was good, and that the court below had erred in sustaining a demurrer thereto. The case will be found reported in 34 Ind. 461.
