Petitioner filed an action in the United States District Court for the Eastern District of Kentucky at Catlettsburg, Ky., against the Chesapeake and Ohio Railway Co., under the provisions of the Federal Employers’ Liability Act, 45 U, S.C.A. § 51 et seq., to recover damages for serious injuries suffered by him while in the employ of the Railway Company at Ashland, Kentucky.
