The plaintiff, Peter Brandt, individually and as executor of the will of Elizabeth Brandt, deceased, commenced this action in the circuit court of Kankakee County on January 30, 1945, to set aside two deeds to the defendant, O. A. Phipps. Of the instruments involved, the first is an executor’s deed, dated August 7, 1940, given by plaintiff as executor of the will of Elizabeth Brandt, conveying to defendant 105 acres of unimproved farm land in Kankakee County, known locally as the Elizabeth Brandt farm.
