This case is before the court on the defendant’s motion for summary judgment. The court has jurisdiction over this case pursuant to 28 U.S.C. § 1332.

FACTUAL BACKGROUND

Plaintiffs Cuba Harmon and Dorothy Bostic own the surface estate of two tracts of land in Buchanan County, Virginia. Plaintiffs Larry Eulis and Mildred Shirlyne Breeding are the owners of the surface estate of a tract of land also in Buchanan County.
