Plaintiff’s claims raise this legal issue: Is Eastern Michigan University Foundation a "public body” as defined by, and thus subject to, the provisions of the Freedom of Information Act (foia), MCL 15.231 et seq.; MSA 4.1801(1) et seq., and the Open Meetings Act (oma), MCL 15.261 et seq.; MSA 4.1800(11) et seq.? The trial court concluded that defendant foundation was not a public body for purposes of either the foia or the oma.
