Background

Despite pleas of not guilty and Appellant’s testimony denying guilt, a special court-martial composed of officer and enlisted members convicted him in 1990 of one specification of cocaine use in violation of Article 112a, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 912a. The court sentenced Appellant to a bad conduct discharge, confinement for four months and reduction to E-l, which was approved by the convening authority.
