SARTAIN, Judge.

Willie M. Brister instituted this suit individually and for and on behalf of his minor son, Jeffery K. Brister, age 3, for medical expenses incurred by plaintiff and for physical pain and suffering of his minor son resulting from an injury the child sustained when he fell from a slide belonging to defendant’s assured, Richard M. Turner. The trial judge found for the defendant declaring that petitioner had failed to prove his cause by a preponderance of the evidence. Counsel for plaintiff moved for a new trial urging that since judgment was rendered new and substantial evidence…
