The only question to be determined in this case is whether Jessie E. Kean became and was the common law wife of Mark H. Maher, for if such relation exists as a valid contract of marriage, she became and was his widow, and his subsequent marriages were invalid.

There is no evidence in the record to show that a marriage ceremony was ever performed between Jessie E. Kean and Mark H. Maher. It appears that in the spring of 1884 Jessie E., who was living with her parents in the city of Washington and was employed as a clerk in the treasury department, and who was of age, left the city of Washington…
