Scolman v. Scolman
Wisconsin Supreme Court
1Opinion of the CourtWilkie, C. J.
This is a divorce case. The sole issue on appeal is whether the trial court applied an incorrect standard in awarding the custody of the parties’ four-year-old son, now six and one-half, to the defendant-respondent mother rather than the plaintiff-appellant father.1 We conclude that the trial court did err in this respect, in according an arbitrary preference to the wife, *763contrary to Wisconsin law and to the specific provisions of sec. 247.24 (3), Stats. We therefore reverse the judgment and remand for further proceedings on the question of custody of the child.
