This was an action for damages alleged to have been sustained when plaintiff, a pedestrian, was struck by an automobile being driven by defendant. Judgment was for the defendant. Plaintiff appeals.

The plaintiff lived west of Kansas City on highway 40. This is a concrete highway composed of four traffic lanes, two on the south for eastbound traffic and two on the north for westbound traffic.
