[ 1 ] At the times here in question the plaintiffs in error Barbur and Hurlburt were, respectively, the duly elected, qualified, and acting auditor of the city of Portland, Or., and sheriff of Multnomah county, of that state, and the other plaintiff in error *729one of the banks of Portland.
