This appeal is from a judgment of the Circuit Court for Multnomah County. The respondent commenced an action at law in that court against the appellants and A. W. Witherell, and alleged in his complaint, in substance, that on or about the twenty-third day of October, 1883, one Fred Kittener was the owner and lawfully possessed of about $830, in national bank bills of the national currency of the United States, of the value of $830, and that at said time the defendants in said action, by force, fraud, and violence, unlawfully took said $830 from the person of the said Kittener, and converted…
