Bell, Judge:

Richardson’s Restaurants, Inc., sued the National Bank of South Carolina (NBSC), alleging damages for (1) conversion; (2) negligence; and (3) violation of the South Carolina Unfair Trade Practices Act. NBSC denied Richardson’s allegations and affirmatively pleaded (1) lack of standing; (2) failure to state a cause of action; and (3) contributory negligence. It also counterclaimed against Richardson’s for breach of contract and crossclaimed against Gurney T. Richardson, as a third party defendant, for breach of a guaranty agreement.
