The wrongful death statute of Louisiana was interpreted by the District Court to hold that the right of surviving children was restricted to legitimate children.* 1 On the ground that the right to recover was based on ‘ ‘ morals and general welfare because it discourages bringing *343children into the world out of wedlock,” this decision was affirmed by the 'Court of Appeals.2 Certiorari was denied by the Supreme Court of Louisiana3 and appeal was taken to the United States .Supreme Court, where probable jurisdiction was noted.4
