KRUEGER, Judge.

Appellant was convicted of the offense of statutory rape and his punishment was assessed at confinement in the state penitentiary for a term of five years.

The record reflects that about the year 1940 or 41 appellant was married to a sister of the prosecutrix; that thereafter, but prior to the commission of the alleged offense, his wife obtained a divorce and she returned to the home of her parents and he went to live with his parents on a farm located in Taylor County, Texas; that on or about the 23rd day of July, 1946, appellant wrote a letter to the prosecutrix who lived with…
