FORMAN, Circuit Judge.

This case arises under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51 et seq. Following a trial in which he ¡recovered a judgment for $15,000, Gurvan B. Brown, appellant, moved for relief from judgment 1 by way of a new trial limited to the issue of damages pursuant to Rule 60(b), Federal Rules of Civil Procedure, 28 U.S.C.A. 2 The motion was denied, Brown v. Pennsylvania R. Co., D.C.W.D.Pa.1960, 179 F.Supp. 858 and Brown appeals.
