NORTHCOTT, Circuit Judge.
This is an appeal from a judgment entered in the District Court of the United States for the District of Maryland against appellant, who was the defendant below (who hereinafter will be referred to as the defendant), in the sum of $8,332.52.
The action was brought by appellee, who is a resident of the state of North Carolina, for the balance of the purchase price of lumber alleged to have been bought by the defendant under the teams of a written contract annexed to the declaration.
