MEMORANDUM
RAMBO, District Judge.
This case is before the court on the motion of defendant, Fidelity and Deposit Company of Maryland (“Fidelity”), for summary judgment, partial summary judgment, judgment on the pleadings or partial judgment on the pleadings, and for the sanctions of dismissal or evidentiary preclusion. Plaintiff, County of Dauphin (“the County”), instituted this action against Fidelity in the Dauphin County Court of Common Pleas, on March 31, 1989.
