Appeal from a judgment of the County Court of Schenectady County (Giardino, J.), rendered January 23, 2001, convicting defendant upon his plea of guilty of the crime of driving while intoxicated.

In satisfaction of a four-count indictment, defendant pleaded guilty to driving while intoxicated. As part of the plea agreement, he signed a waiver of the right to appeal and was to be sentenced to 1 to 3 years in prison. Defendant also signed a Parker admonishment acknowledging, among other things, that if he failed to appear for sentencing, County Court would not be bound by the sentencing…
