Appeal from a judgment of the Supreme Court (McNamara, J.), entered August 18, 2000 in Albany County, which, in a proceeding pursuant to CPLR article 78, granted respondent’s motion to dismiss the petition as untimely.

Petitioner is the former Deputy Director of Psychiatric Center 2, a facility operated by the State Office of Mental Health.
