Appellant, Larry Joe Hopkins, hereinafter referred to as defendant, was charg*580ed, tried and convicted in the District Court of Tulsa County, Oklahoma, for the offense of Second Degree Burglary, After Former Conviction of a Felony; his punishment was fixed at twenty (20) years to sixty (60) years imprisonment, and from said judgment and sentence, an appeal has been perfected to this Court.

At the trial, Rex Apker testified that at approximately 2:25 p. m. on the 4th day of October 1968, he observed the defendant and James Clinton Byrne walk to the front porch of the G. R.…
