The record discloses that, hy leave of court, an information based on affidavit was filed on September 27, 1909, charging the two defendants here complaining, jointly with one R. L. Cunningham, with an attempt to commit the crime of larceny, through-the use of explosives. On the same day, the defendants appearing to be indigent, H. J. Baird, Esq., an attorney and counselor of this state, was appointed to defend.
