GEORGE W. Latimer, Judge:

The accused stands convicted by a general court-martial of leaving his post as a sentinel before being relieved properly in violation of Article 113, Uniform Code of Military Justice, 50 USC § 707. He was sentenced to a dishonorable discharge, total forfeitures and confinement for two years. The convening authority suspended the dishonorable discharge, but otherwise affirmed. A board of review in the office of The Judge Advocate General of the Army upheld the findings and sentence as modified and we accepted the cause to determine whether the law…
