These consolidated petitions, filed by the Commissioner of Social Services of New York City under section 358-a of the Social Services Law, involve the effect of the child welfare and public assistance systems on relatives who have on their own volition, without government intervention, taken over the care of children under the age of 18 from their parents.1 In accordance with the policy adopted several years ago by the Department of Social Services (hereinafter the Department), the petitions ask the court to approve its grant to such relatives of foster…
