In this action for a declaratory judgment both parties move for summary judgment. The complaint seeks a declaration that subdivision 14 of section 371 of the Social Services Law is unconstitutional as violative of the Equal

*380Protection and Due Process Clauses of the United States Constitution. Plaintiffs also assert that the 'aforesaid section violates the spirit and intent of the Federal Social Security Act. Defendants seek summary judgment dismissing the complaint as a result of plaintiff’s ineligibility to obtain benefits pursuant to subdivision 14 of section 371 of the Social Services Law.…
