This matter is before the Court on the Defendants’. Motion for Summary Judgment. For the reasons discussed below, the motion will be granted.

I. BACKGROUND

In the United States District Court for the District of Utah, the plaintiff was indicted, tried and found guilty of one count of possession with intent to distribute cocaine.
