This action was begun July 22, 1909, by L. E. Taylor against the Gulf, Colorado & Santa Fe Eailway Company for damages in the sum of $1,990 alleged to have been' caused by the carelessness and negligence of defendant through its agents. At the time of the alleged injury the plaintiff was in the employ of - defendant in the capacity of an ordinary section hand, and as such was under the authority and direction of a section foreman or boss.
