MEMORANDUM OPINION AND ORDER

HATFIELD, District Judge.

The present action was instituted in the District Court of Flathead County, Montana and removed to this court by the named defendants. The matter is now before the court upon the plaintiff’s motion requesting the court to remand the action to that same state court. The plaintiff previously requested that the action be remanded, but the court denied that request without prejudice.
