In this action taxpayers in Kansas City, Kan., have brought suit against the city and its officers to enjoin the issuance of tax bills against their property to pay for the cost of repaving certain blocks of Osage avenue. Judgment was for certain of the plaintiffs. Defendants appeal.

For the purpose of consideration in this opinion the plaintiffs may be divided into two classes: Those who signed the petition whereby the governing body of the city was to do the paving and those who did not.
