Action of Tort to recover damages for the negligent handling of the dead body of the plaintiff’s minor child. Plea, the general issue. Trial by jury at the September Term, 1917,-Franklin County, Waterman, J., presiding. At the close of the plaintiff’s evidence a verdict was directed for the defendant. The plaintiff excepted. The opinion states the case.

The plaintiff seeks to recover damages for the claimed negligence of the defendant in handling the dead body of her minor child. The trial was by jury. At the close of the evidence the court directed a verdict for the defendant, and the plaintiff brings the case here for review on .exceptions.

The child was a son of the plaintiff by a former marriage and at the time of his death about eight years of age. The plaintiff and her present husband took'the child to the Fanny Allen Hospital for a surgical operation, as a result of which the child died. The body was prepared for burial by an…
