delivered the opinion of the court:

After a jury trial in the circuit court of Madison County the defendant was convicted" of the crime of armed robbery and sentenced to a term of imprisonment of not less than 15 nor more than 3Ó years.

The indictment alleged that the defendant, while armed with a gun, took certain property from one Thomas Courtney at a Sunoco gasoline station in Madison County. The defendant, was represented by retained counsel.
