OPINION

DIANA GRIBBON MOTZ, Circuit Judge:

A grand jury indicted Georges DeBeir of one count of traveling in interstate commerce with the intent to engage in a sexual act with a minor, in violation of 18 U.S.C.A. § 2423(b) (West Supp.1999). After DeBeir pled guilty to this offense, the district court, departing downward three levels from the applicable range set forth in the United States Sentencing Guidelines, sentenced him to five years probation.
