This action was brought to recover the possession of thirty-eight hundred and sixteen tickets for passages from Europe to America by the steamships' of the plaintiff,' .alleged by the latter to have been detained from it by the defendant. In 1865 the defendant was appointed by the plaintiff as its agent for the sale of such passage tickets, and he continued in that service until in October, 1875, when his agency was terminated by notice to that effect given him by the plaintiff.
