On September 6, 1967, Appellee Robert J. Morrison filed a complaint charging negligence for personal injury and property damage designating Audrey L. Bailey as defendant, which complaint purported to result from an automobile collision between said Robert J. Morrison and Audrey L. Bailey and the case was tried by the court without the intervention of a jury, which trial resulted in a judgment for Robert J.
