Eunice Davis, as executrix of the last will and testament of William H. Davis, deceased, brought an action in the district court of Okfuskee county against C. M. Serán to recover the sum of .$1,000, alleged to have been collected by C. M. Serán upon a policy of insurance upon the life of William H. Davis. The trial court rendered judgment in favor of the plaintiff and against the defendant, C. M.
