Ross, C. J. —

This action was commenced November 7, 1893, by the appellee against the appellant and one Thomas N. McNear, upon a note dated October 21, 1881, calling for $300, payable to the order of A. W. Roberson, and due one year after date. It is alleged in the complaint that A. W. Roberson, the payee, died intestate since the execution of the note; that all of his debts have been paid and that appellee is his only heir. A number of credits on the note amounting to $83.15 were alleged, leaving the balance, with interest and attorney’s fees still due, for which judgment was demanded. No…
