MEMORANDUM OPINION AND ORDER

GETZENDANNER, District Judge:

This employment discrimination suit is before the court on defendant’s motion for summary judgment. For the reasons stated below, the court grants defendant’s motion as to Count I of the Amended Complaint and denies it as to Count II of the Amended Complaint. Defendant also has filed a motion to strike, which the court denies without prejudice.
