Defendant Libby, McNeill & Libby operates a cannery near the city of Yakima. Much of the labor employed in the business is transient, and, in order to accommodate its employees, there being no dwellings nearby convenient for occupation by defendant’s employees, defendant, prior to 1924, erected near its plant two rows of tent houses, one along each side of a north and south row of large black walnut trees.
