Mary Andrews, in her official capacity as Civil Service Director of the City of Lubbock, and as Managing Director of Human Resources of the City of Lubbock; Ken Walker, in his official capacity as Chief of Police of the City of Lubbock; and the City of Lubbock (collectively the City), appeal from a summary judgment rendered in a declaratory judgment action in favor of police officer Eric M.
