MEMORANDUM OPINION AND ORDER

I. INTRODUCTION

This cause is before the court on a Motion for Summary Judgment filed by Defendant Nelson and Affiliates, Inc. (“Nelson”) (Doc. #80). The Plaintiffs, Robert Garrett (“Garrett”) and Sonya Garrett (collectively, the “Garretts”) filed an Amended Complaint (Doc. # 5) in this case against Nelson and several other defendants (the “Dismissed Defendants”). 1 The Amended Complaint alleges that Nelson is liable to the Garretts on the basis of (1) negligence and wantonness on the basis of Nelson’s acts (Count Two); (2)…
