— Appeal by the defendant from a judgment of the County Court, Nassau County (Delin, J.), rendered May 21, 1984, convicting him of murder in the second degree, upon a jury verdict, and imposing sentence. The appeal brings up for review an order of the same court, dated May 10, 1984, which denied the defendant’s motion to vacate the verdict pursuant to CPL 330.30.

*684Ordered that the judgment is affirmed.
