In February, 1916, the plaintiff delivered to the defendant three carloads of empty projectiles known as eighteenpounder high explosive shells, to be carried from Woonsocket, Rhode Island, to New York and delivered alongside a ship to be "designated by the consignee, the forwarding agents for the British government. On February 19, while two carloads of projectiles were in transit on a lighter belonging to one of the defendant’s connecting carriers, a storm arose and the cargo was thrown into the harbor.
