ORDER ON MOTION TO DISMISS

KOVACHEVICH, District Judge.

This cause is before the Court on Defendant, DOWNTOWN MEDICAL AND DIAGNOSTIC CENTER’S, Motion to Dismiss Plaintiff, VICTORIA PATTERSON’S, Complaint and Amended Complaint filed July 11, 1994 and August 15, 1994, respectively (Docket No. 3) and Plaintiff’s response thereto, filed August 23, 1994.

A complaint should not be dismissed for failure to state a claim unless it appears beyond doubt that Plaintiff can prove no set of facts that support a claim for relief. Conley v. Gibson, 355 U.S. 41, 45-47, 78 S.Ct. 99, 101-03, 2 L.Ed.2d 80 (1957).…
