BOND, Justice.
On January 31,1918, appellee, H. R. Chad-dick, sold fifty bales of cotton to Carver & Co., and in carrying out said sale delivered the cotton to the Missouri-Kansas & Texas Railroad Company of Texas for shipment from McKinney, Tex., to Greenville, Tex., to be there compressed, reloaded, and shipped to Lumberton, N. C. The railroad company received the cotton and issued and delivered to Chaddick a shipper’s order bill of lading therefor, in which said cotton was consigned to the order of Carver & Co., notify W.
