Mugglin, J. Appeal from a judgment of the County Court of Warren County (Austin, J.), rendered May 7, 2003, upon a verdict convicting defendant of two counts of the crime of criminal sale of a controlled substance in the third degree.

On May 8 and 9, 2002, a confidential informant, working under the direction of officers of the Glens Falls Police Department, made purchases of crack cocaine from defendant at 25-D Henry Hudson Town Houses in the City of Glens Falls, Warren County.
